Natasha Kapp to present at Guernsey Association of Trustees (GAT) event
The deadline for all overseas entities owning UK land to have an overseas entities registration number (OEID) by 1 February 2023 remains. The complexity of the analysis of what needs to be registered in the case of multi-layered trust and foundation structures has been overlooked or underestimated. A significant number of applications have been rejected. Given the criminal sanctions for getting it wrong which apply to advisers and the overseas entities and its officers, Natasha will look at what trustees need to do to ensure that they are properly advised on how to comply.
Natasha will also look at the decision of the Court of Justice of the European Union (CJEU) that provisions of 5AMLD requiring Members to give the public unlimited access to registers of beneficial owners is invalid and what this means for the UK's public registers (ROE and PSC registers) and the Crown Dependency's previous commitment regarding implementation of such measures.
